1. Technical Delivery & Multi-Domain Infrastructure
This policy governs all data processing for calculation tools, directories, and affiliate routing provided by Service Directories, Inc. (the "Company"). This includes interactions on Company-owned primary and secondary domains (the "Sites") and third-party licensed or embedded sites ("Licensed Mode"). We utilize third-party Infrastructure Providers (hosting, servers, CDN, and email/API delivery services such as Resend.com and Zapier) to deliver these Tools. Regardless of the URL used to access the Tools, all data is processed within the same proprietary production environment governed by this policy.
2. The "Pass-Through" Data Model (Zero-Retention for Financial Inputs)
- No Persistent Database for Financials: We do not maintain user accounts or store specific financial inputs (e.g., home price, down payment, interest rates) in a permanent database.
- Transient Processing: Calculator data is processed in volatile memory (RAM) only for the duration required to generate a calculation or facilitate a requested transmission.
- Instant Purge: Once your session is closed or the calculation is delivered, the specific financial math inputs are purged from our active memory.
- Transactional Logs: You acknowledge that third-party infrastructure providers may maintain secure transactional logs (e.g., recipient address, delivery status, IP metadata) for security auditing and delivery verification.
3. The "Once" Clause & Data Transit Risk
The Company assumes no responsibility for the security or integrity of your data once it leaves our production environment.
- Transit Risk: Any interception, "sniffing," or hacking of data during transit between our environment and your browser—or between our environment and an Affiliate Partner or Lender's website—is at the User's sole risk.
- Infrastructure Failures: We are not liable for the independent security failures or breaches of our third-party infrastructure partners.
4. Service Provider & Publisher Status
The Company acts strictly as an independent publisher, advertising service, and data router. We are not a lender, bank, or mortgage broker. Any requests regarding data access, privacy rights, or loan applications must be directed exclusively to the third-party lender or affiliate network you choose to interact with.
5. Mortgage Directory & Voluntary "Direct Hand-off"
- Directory Listings: We provide a directory of third-party mortgage professionals and affiliate links; we do not endorse, verify NMLS licensure, or supervise these professionals.
- Lead Transmission Notice: If you choose to contact a lender or click an affiliate link via our interface, you are performing a voluntary "Direct Hand-off." Upon transmission, your data is governed by that specific lender or affiliate network's privacy policy. We assume zero liability for how that third party stores or uses your information for underwriting or marketing.
6. Zip Code Usage & Geolocation
We may request a ZIP code to provide geographically relevant mortgage rates, property tax estimates, and local broker listings. This data is used solely for filtering and math calculation, and is not used to create a permanent personal profile of the User.
7. Cookies, Analytics, and Tracking Technologies
We use cookies and similar technologies (e.g., Google Analytics, Affiliate Tracking Pixels) to ensure the Tools function, track affiliate commissions, and monitor system health. You consent to the collection of technical identifiers (IP addresses, browser types) for these purposes. You may disable cookies in your browser, but the mathematical Tools and partner links may cease to function properly.
8. Children's Privacy (COPPA)
Our financial services are intended strictly for adults (18+). We do not knowingly collect or solicit personal information from anyone under the age of 18. If we discover data from a minor has been processed, it will be deleted immediately.
9. Data Security & Statutory Compliance
We implement measures designed to secure data from accidental loss in accordance with applicable laws, including the NY SHIELD Act. However, you acknowledge that the transmission of financial information via the internet is never completely secure. Any transmission is at your own risk.
10. Data Breach Notification & Zero-Retention Presumption
Because we operate a "Blind System" that purges specific calculator financial inputs from RAM instantly, it is legally presumed that no user-entered financial calculation data (e.g., loan balances, credit scores entered into the tool) exists within our environment to be compromised. We are not responsible for breaches occurring on Lender domains or third-party infrastructure.
11. Mandatory Confidentiality of Privacy Disputes
Consistent with the Terms of Use, any inquiry, grievance, or dispute regarding our privacy practices is subject to a Strict Confidentiality Mandate. User is strictly prohibited from making any public disclosure or derogatory representation regarding alleged "leaks," "glitches," or technical performance.
12. Absolute Limitation of Technical & Hosting Liability
The Company is not liable for privacy "glitches" or data exposure resulting from programming errors, coding bugs, hosting infrastructure failures, or Acts of God (lightning strikes, floods, fires, etc.).
13. Shortened Statute of Limitations (30-Day Window)
REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY MUST BE FILED WITHIN THIRTY (30) DAYS AFTER SUCH CLAIM AROSE OR BE FOREVER BARRED.
14. Absolute Privacy Liability Ceiling
Total Liability: $100.00 USD. To the maximum extent permitted by law, the Company's total aggregate liability for any and all privacy-related claims is fixed at $100.00 USD.
15. Exclusive Venue: Nassau County Small Claims Court
Any and all privacy disputes shall be heard exclusively in the Small Claims Part of the District Court of Nassau County, New York.
- Physical Requirement: User must physically appear in Nassau County to prosecute any claim.
- Jury Waiver: YOU IRREVOCABLY WAIVE THE RIGHT TO A TRIAL BY JURY AND CLASS ACTION PROCEEDINGS.
16. California & State-Specific Rights (CCPA/CPRA)
Because we operate a non-persistent pass-through model for calculator inputs:
- Right to Delete: Requests for deletion of financial inputs will result in a "No Data Found" response, as all specific inputs are purged upon session termination by default.
17. Conflict of Terms & Mastery Clause
In the event of a conflict between this Privacy Policy and the Terms of Use, the Terms of Use shall prevail.
18. Right to Modify at Will (Modification Clause)
The Company reserves the right, in its sole and absolute discretion, to modify, update, or revise this Privacy Policy at any time without prior notice. Your continued use of the Tools constitutes your absolute and irrevocable acceptance of the revised Policy.
19. Privacy Inquiries & Contact
All formal inquiries regarding this Privacy Policy or our data processing practices should be directed to Service Directories, Inc. via the contact methods provided on our primary domain (thebestmortgagecalculator.com). Requests sent to third-party lenders will not be redirected to the Company.
20. TCPA Compliance & Legal Audit Trail Exception
Notwithstanding the Zero-Retention policy for financial calculator inputs (Section 2), if a User explicitly opts-in via a web form to be contacted by a third-party mortgage professional, the Company legally mandates the retention of a "Compliance Audit Trail." This trail includes the User's Name, Phone Number, Email, IP Address, Timestamp, and the exact consent language agreed to. This specific data is retained securely (via third-party tools such as Zapier/Google Workspace) indefinitely and strictly for the purposes of Telephone Consumer Protection Act (TCPA) compliance, fraud prevention, and legal defense against telemarketing claims.
